Waiver, Release of Liability and Assumption of Risks

To be completed and signed by every Member and Guest using the Charles River Tennis Club (CRTC) tennis courts and property or any other property CRTC makes available for its activities (hereinafter, the “Premises”):

Disclaimer: CRTC is not responsible for any injury to, including death, or loss of property, of any person suffered while on the Premises or participating in the use of the Premises for any reason including but not limited to playing or practicing tennis or spectating or any other activity occurring in or about the Premises.

In consideration of my participating in CRTC activities and use of the Premises, I hereby release from, and covenant not to sue members, directors, officers, employees, representatives, agents, lessors and lessees for,any and all present and future claims resulting from negligence, inherent risk of sport or exercise or otherwise; including but not limited to any loss, injury, damage or liability sustained by me while on or about the Premises.

I am fully aware and understand that CRTC does not employ or contract with any medical service providers for ordinary or emergency medical services, including but not limited to emergency cardiovascular assistance. I will be fully responsible for any use I make of medical supplies or equipment which may be found on the Premises and agree that the terms of this waiver and release shall apply to any person who in good faith uses such supplies or equipment to assist me if I am unable to do so.

I am also fully aware and understand that losses, injury, damage, liability, disability, or even death may result from actions, inactions or negligence on my part, on the part of CRTC, or on the part of others, as well as from the rules of play of tennis and the condition of the Premises.

I further agree that I am knowledgeable in the proper use of the Premises and with the risks inherent in playing tennis.

I further agree to indemnify and hold harmless CRTC, its members, directors, officers, employees, representatives, agents, lessors and lessees for and from any and all claims arising from my involvement in activities of CRTC at the Premises or otherwise or incidental thereto wherever, whenever, and however the claims may arise; including but not limited to travel to and from the Premises or related activity sites.

I assume all the foregoing risks and accept personal responsibility for any damages and loss following any loss of property, injury, permanent disability, or death resulting from my use of the Premises or participation in any CRTC activities.

I have read and fully understand the above waiver, release, and assumption of risk and fully understand that I have given up substantial rights by signing this waiver, release, and assumption of risk, and sign it voluntarily.

Any person under the age of 18 years must have a parent or guardian co-sign this form.

I agree to abide by the Rules of the Club at all times. In addition, I acknowledge that my execution and delivery of the Club’s Waiver, Release of Liability and Assumption of Risks form, a copy of which has been provided to me, is a precondition to my acceptance into the Club. I have duly signed and am tendering such Waiver form herewith. In the event that I neglect to do so or my signed Waiver form is lost or misplaced, my payment of all or a portion of my membership dues shall be deemed to establish my consent to and acceptance of the terms of such Waiver form.
